CTE and CTO in Plain Terms

CTE and CTO in Plain Terms

Under the Water Act, 1974 and the Air Act, 1981, an industry needs Consent to Establish from the State Pollution Control Board before it builds, and Consent to Operate before it starts production. Think of CTE as permission to set up and CTO as permission to run. Both come with conditions on effluent, emissions and waste that you have to keep meeting for as long as the consent lasts.

Whether you need consent, and for how long it stays valid, depends on your category. Industries are grouped as Red, Orange, Green or White by pollution potential, under the CPCB categorisation that the States adopt. White category units are generally outside the consent regime. Hotels, hospitals, larger restaurants, construction projects and DG sets can also be covered depending on size and the State notification, which comes as a surprise to many service businesses.

What Goes Into the Application

What Goes Into the Application

Site and layout plans, land documents, a description of the process with raw materials and products, water balance, effluent treatment and air pollution control details, and a chartered accountant certificate of project cost. We work with your plant engineers on the technical annexures, file on the Board portal and handle the inspection and queries that follow.

Consent is rarely the only environmental approval you need. Units generating hazardous waste need authorisation, hospitals need bio-medical waste authorisation, and brands putting plastic packaging, electronics or batteries on the market need EPR registration. We handle these with the consent, track renewal dates, file returns, and reply to show cause and closure notices when they arrive.

Questions clients usually ask

What is the difference between CTE and CTO?

CTE is needed before you build or set up the unit. CTO is needed before you start operations, once the Board is satisfied the pollution control systems are in place.

Does a hotel or restaurant need pollution consent?

It depends on size and the State notification. Larger hotels, banquet halls and restaurants with DG sets or heavy water use often do, while small units may be exempt.

What if a unit runs without consent?

The Board can order closure, cut power and water, levy environmental compensation and start prosecution.
